The Shared
Services Working Group is led by Helen Randall of
Trowers & Hamlins LLP and facilitated by Duncan Osler of
MacRoberts. Members of the group have contributed four
practical case studies and a summary of the complex and sometimes
contradictory CJ EU caselaw relating to the issue of
shared services.
This is particularly topical given the recent
context of the coalition government's Spending Review which will
inevitably lead contracting authorities to consider the extent to
which they can save costs and achieve efficiencies by sharing
services and in some cases, merging management
roles or departments.
The Group has produced a paper which it hopes will
clarify some areas of current uncertainty and assist in the
development of best practice across public procurement and the
promotion of fair and effective competition for public
contracts. The paper was presented at an event held on 27
January 2011. Since the paper was produced the Supreme Court
has given its judgment in the case of Brent London
Borough Council and others v Risk Management Partners Limited
[2011] UKSC 7. Given the implications of the Supreme
Court’s judgment the Working Group has prepared an
addendum to its original paper.
