The Procurement Lawyers' Association Remedies Working Group's response to the OGC's Consultation Document: 2nd Consultation on implementing the new Remedies Directive was submitted to the OGC in July 2009.

The Remedies Working Group of the PLA has considered the OGC's consultation paper, together with the Draft Regulations. A number of issues of concern have been considered and a discussion of each of these issues is set out in the response.

The group consisted of: Wesley Hall, Nancy Dickie, Julie Nazerali, Rosemary Choueka, Ruth Smith, Totis Kotsonis, Victoria Simkins, James Bryan, Declan Magee, Mark Clough, Charles Morrish, James Falle, Rosemary Boyle, Catherine Thompson, Elisa Holmes and was led by Michael Bowsher QC.

The response has been contributed to and worked on by the group for and on behalf of the PLA as a whole and represents the broad consensus of views from the group. It is to be emphasised that no particular view is to be attributed to any particular member and none of these members are bound by the content of the response.
